Abstract

This paper critically examines the significance of the Uniform Civil Code in promoting gender equality, with a focused analysis on women’s rights under India’s personal laws. Beginning with an introduction to the UCC’s constitutional mandate under Article 44, the paper explores the challenges posed by the coexistence of multiple personal laws that govern marriage, divorce, inheritance, and adoption across different religious communities. The historical context illuminates how these personal laws have often embedded patriarchal norms that disadvantage women. Proceeding to assess the social impact and challenges of implementing a UCC, the paper reflects on the tension between legal uniformity and cultural pluralism, highlighting how resistance arises from concerns over religious freedom and identity. Legislative measures and judicial responses, especially progressive judgments such as those by the Karnataka High Court advocating equal inheritance rights, are examined for their roles in fostering gender justice. The paper also undertakes a comparative study with select countries to understand how uniform personal laws have successfully balanced gender equality with cultural diversity, offering lessons for India’s complex context. The conclusion synthesises insights, affirming that the UCC represents not just a legal reform but a vital mechanism to uphold women’s dignity and equal rights nationwide. Practical suggestions emphasise inclusive dialogue, legal literacy and gender-sensitive policymaking to overcome socio-political barriers. This comprehensive analysis contributes to the evolving discourse on how India can reconcile its pluralistic heritage with the constitutional promise of equality and justice for women.
